Before publishing: replace every highlighted placeholder, and have a lawyer review this. These terms cover consumer sales of a health-related digital product across borders — the withdrawal, refund, and liability clauses in particular carry real legal weight and vary by jurisdiction.

1. Who these terms are with

These Terms and Conditions govern your use of Set Point (the “Service”), operated by Full legal name, address, Germany (“we”, “us”). Contact: your@email.com. Full company details are in our Impressum.

By purchasing or using the Service you agree to these terms. If you do not agree, do not use the Service.

2. What the Service is

Set Point provides personalised nutrition information generated from data you supply. We offer:

Basic: a calculated daily calorie target, a protein/fat/carbohydrate breakdown, a downloadable PDF plan, an explanation of the calculation, and access to an AI assistant that can answer questions about your plan.
Full plan: everything in Basic, plus a food-preference questionnaire, an AI-generated meal-by-meal plan matched to your targets, and the ability to request adjustments to that plan through the AI assistant for a limited period after purchase.

Plan adjustments through the AI assistant are available for 3 days from purchase. After that period you retain full access to view and download your plan indefinitely, but the plan can no longer be changed.

Each purchase includes a limited number of PDF generations (currently 3). Downloading a plan you have already generated is unlimited and free.

3. Eligibility

The Service is available only to individuals aged 18 or over. The equations used are validated for adult bodies and are not appropriate for people who are still growing. By purchasing you confirm you are at least 18. We may refuse or cancel any order where we believe this is not the case.

4. Accounts

You need an account to purchase. Sign-in uses a one-time link sent to your email address rather than a password. You are responsible for keeping access to that email address secure, and for the accuracy of the information you enter. Plans are calculated from what you tell us — inaccurate inputs produce inaccurate outputs.

5. Prices, currency and payment

Prices are shown on the site before purchase and depend on your country. Customers in Egypt are charged in Egyptian Pounds (EGP); customers elsewhere are charged in Euros (EUR). The price displayed at checkout is the price you pay.

Payment is processed by our payment providers. We never receive or store your full card details. Payment is taken before your plan is generated. Your plan is unlocked once payment is confirmed by the provider.

State whether prices include VAT / whether the Kleinunternehmerregelung applies — confirm with your Steuerberater.

6. Delivery and immediate access

The Service is digital content delivered electronically. Your plan is generated and made available immediately after payment is confirmed, through your account on this website.

7. Right of withdrawal and refunds

Immediate access means you waive your 14-day withdrawal right. Consumers in the EU normally have 14 days to withdraw from a distance contract. Because your plan is generated and made available to you straight away, you are asked at checkout to expressly request immediate performance and to acknowledge that you lose your right of withdrawal once the plan has been generated. If you do not give that consent, your plan will not be generated immediately.

Beyond that, our refund position is:

If your plan has not yet been generated, you may request a full refund.
If the Service fails to deliver what was purchased due to a fault on our side, contact us and we will correct it or refund you.
Once a plan has been generated and made available, we do not offer refunds for change of mind, since the digital content has been delivered in full.

8. AI-generated content

Parts of the Service — including meal plans, written explanations, and assistant replies — are generated using artificial intelligence. AI output can contain errors or inconsistencies. We apply automated checks to keep calculated figures internally consistent, but you should review your plan and apply your own judgement. Do not rely on AI-generated content as a substitute for professional advice.

9. Health disclaimer

Set Point provides educational estimates only. It is not medical advice, diagnosis, or treatment, and it does not replace consultation with a physician, registered dietitian, or other qualified healthcare professional.

Calorie and macronutrient figures are estimates produced by standard equations (Mifflin-St Jeor) and general nutritional guidelines. Individual requirements vary. Consult a healthcare professional before beginning any new diet or training programme — and especially if you are pregnant or breastfeeding, have or have had an eating disorder, have diabetes, kidney, liver, cardiac or metabolic conditions, or take medication that may be affected by changes in diet.

You use the Service and follow any plan at your own risk.

10. Acceptable use

You agree not to:

Provide false information, including about your age
Resell, redistribute, or publish plans or materials generated for you
Attempt to bypass payment, access other users’ plans, or interfere with the Service
Use the AI assistant for purposes unrelated to your nutrition plan, or to attempt to extract system instructions

We may suspend or terminate access where these terms are breached.

11. Intellectual property

The Service, its design, text, branding and underlying software remain our property. Your personal plan and its PDF are licensed to you for your own personal, non-commercial use. You may keep and print your plan; you may not redistribute or resell it.

12. Availability

We aim to keep the Service available but do not guarantee uninterrupted access. The Service depends on third-party providers for hosting, payment, authentication and AI generation, and may be temporarily unavailable for maintenance or reasons outside our control.

13. Limitation of liability

Nothing in these terms excludes or limits liability where it may not lawfully be excluded — including liability for death or personal injury caused by negligence, for intent or gross negligence, or under applicable product liability law.

Subject to that, our total liability arising from your use of the Service is limited to the amount you paid for the plan in question. We are not liable for indirect or consequential loss, or for outcomes arising from following a plan without appropriate professional advice.

14. Data protection

We process personal data, including health-related data, as described in our Privacy Policy. Please read it before purchasing.

15. Changes to these terms

We may update these terms. The version in force is the one published at the time of your purchase. Material changes will be reflected in the “last updated” date above.

16. Governing law and disputes

These terms are governed by German law. Where you are a consumer resident in another country, you retain the benefit of any mandatory consumer-protection provisions of your country of residence.

The European Commission provides an online dispute resolution platform at ec.europa.eu/consumers/odr. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
